THE EVOLUTION OF RESTRAINING ORDERS MECHANISM AS A MEAN OF PROTECTING VICTIMS OF DOMESTIC VIOLENCE IN FOREIGN COUNTRIES

Abstract

The article is devoted to a comparative analysis of the approaches of foreign countries to the regulation of legal and institutional mechanisms concerning the implementation of restraining orders as a tool of prevention and combating domestic violence. It is concluded that despite significant differences in approaches to regulating the mechanism of restraining orders embodied in the national laws of the studied states, the mechanism as a whole demonstrates a high degree of effectiveness both concerning the combating and prevention of situations of domestic violence. The article focuses on approaches to differentiating restraining orders depending on the specifics of legislative regulation of the corresponding mechanism in the national legal orders of the states under consideration; their specific features are indicated, in particular, target orientation, subjects and application procedure. The authors also highlight some of the shortcomings inherent to the restraining orders tool, draw attention to the lack of a mechanism for states’ mutual recognition of restriction measures, which could negatively affect the effectiveness of international cooperation in combating domestic violence. A generalized description is given to international legal instruments in the field of combating domestic violence and violence against women, the conceptual role of the mechanism of restraining orders in the context of fulfilling
international legal obligations arising from the relevant acts. The practice of international judicial and quasi-judicial institutions in the respective field is analyzed.
