QUALIFYING FEATURES OF FORCE MAJEURE: DOCTRINAL APPROACHES

Abstract

The article contains analysis of doctrinal approaches of determining the aggravating circumstances of force majeure. It is concluded that under the irresistible force one should understand the circumstances that are characterized by extraordinary, inevitable and external quality regarding activities of the responsible person and make it impossible to complete or partially complete the obligation by the person mentioned above; force majeure is recognized only if there is a set of it’s distinctive aggravating qualities such as «complete or partial failure possibility of commitment», «extraordinarity» «objective inevitability» and «external nature».
