TERMS OF FORCED CESSATION OF PROPERTY RIGHTS IN CONNECTION WITH PUBLIC NECESSITY

Abstract

The article is devoted to problems of legal regulation of forced cessation of property rights in connection with forced cessation of ground area, other real estate located therein for reasons of public necessity. As a result of the analysis of the current legislation, the scientific literature, the proposals on improvement of positions of the Law «On alienation of the ground areas, other objects of real estate located on them which are in the private property for social needs or for the reasons of public necessity» regarding concept definition «exception to reasons of public necessity», the conditions which allows forced cessation of property rights in connection with public necessity are formulated.
