THEORETICAL AND LEGAL GROUND OF «RIGHT ON RIGHT» CONSTRUCTION EXISTENCE IN UKRAINIAN AND RUSSIAN CIVIL LAW

Abstract

In the article on the basis of doctrine positions and norms of current Ukrainian and Russian legislation the grounded conclusions about the necessity of confession of «right on right» construction as a legal fiction are done. Understanding the essence of such fiction will help theorists and practitioners to find an application for established by law «right on right» construction.
