FAULT AS A FREEDOM EX POST FACTO

Abstract

The article is a result of philosophical reflection on the problem of fault in law. The author analyses existent conceptions of understanding fault and proposes the new perspective on the matter, according to which fault is treated as a retrospective affirmation of freedom.
