THE PRINCIPLE OF RESPECT FOR HUMAN RIGHTS AND FREEDOMS IN THE ACTIVITIES OF THE NATIONAL POLICE OF UKRAINE: ITS CONTENT AND STRUCTURE

The article examines the content and structure of one of the main principles of the National Police of Ukraine – the observance of human rights and freedoms. It is noted that in the course of performing their professional duties, police officers should clearly understand that human rights and freedoms, even under martial law and the possibility of their partial restriction, remain unchanged standards, and this principle is an integral part and the main guideline of their activities. Based on a comprehensive analysis, it is proved that the principle of respect for human rights and freedoms is complex in content and contains multiple components relating to the restriction of human rights, the prohibition of promoting, committing, inciting or tolerating any form of torture, cruel inhuman or degrading treatment or punishment, prohibition of any privileges or restrictions based on race, colour, political, religious or other beliefs, sex, ethnic or social origin, property, place of residence, language or other status. The study reveals the essence and interconnection of the components of this principle, and proves that, in general, it is an independent principle of the National Police which formulates the human-centred direction of police activity, and in terms of its semantic meaning it is one of the conceptual principles which formulates the appropriate forms and methods of a comprehensive strategy in police activity with regard to the observance of human rights and freedoms guaranteed by the Constitution and laws of Ukraine. It is noted that establishing the priority of human rights and freedoms in the activities of the National Police is an important step towards the integration of the basic principles of European legislation into the national legal framework and the introduction of European standards for the protection of human rights and their practical application in the work of the National Police of Ukraine.
