ADMINISTRATIVE AND LEGAL PROTECTION OF INFORMATION: THEORETICAL AND LEGAL ANALYSIS

Abstract

The article is devoted to identifying the content and essence of administrative-legal protection of information. It is noted that administrative law plays a key role in the mechanism of forming a stable information environment in Ukraine, since, in addition to determining the procedure for organizing and functioning of public administration bodies that carry out administrative- legal protection of information, it also provides the organizational foundation for implementing other important measures related to countering information threats, ensuring the continuity of critical information processes, and introducing digital solutions into everyday practice. It is established that administrative-legal protection of information is a type of activity of public administration bodies directly related to ensuring the stability of the information environment at the individual, collective, and national levels through the implementation of preventive and operational measures aimed at preventing violations, restoring infringed rights and interests of subjects of information relations, as well as creating conditions for the safe use of information as a strategic resource for public purposes. It is noted that the individual, collective, and national levels of the information environment are interrelated. It is proposed to distinguish two basic types of administrative-legal protection of information, namely, protection of open information or information with restricted access. In general, it is summarized that its content encompasses a set of measures aimed both at guaranteeing the informational rights of individuals and at protecting national interests in the field of information security; it serves as a key mechanism for implementing state information policy, ensuring the proper functioning of the legal regime of access to open and restricted information in a security context.
