LEGAL REGULATION OF THE FUNCTIONING OF THE URBAN PLANNING CADASTRE IN UKRAINE

The article is devoted to the analysis of the legal regulation of the functioning of the urban planning cadastre in Ukraine. The study examines the legislative definition of the cadastre, its components, including its integration with the Unified State Electronic System in the field of construction, as well as certain subordinate legal acts regulating its maintenance at the national, regional, and local levels. A number of problems in the current legal regulation have been identified: conceptual overload and inconsistency of the legislative definition of the urban planning cadastre, inclusion of construction norms and rules as part of the cadastre, legal uncertainty regarding its relationship with the Unified State Electronic System in the field of construction, transitional nature of legal regulation, evaluative character of integration with the State Land Cadastre, fragmented establishment of cadastre services at regional and local levels, and the absence of clear timelines and effectiveness criteria for the experimental project concerning the state urban planning cadastre. Based on this analysis, directions for improving legal regulation are proposed: clarifying the content and functions of the cadastre, reviewing the inclusion of construction norms and rules, clearly defining its relationship with the Unified State Electronic System in the field of construction, specifying mechanisms for integra¬tion with the Land Cadastre, updating subordinate acts according to the current institutional structure, establishing timelines and evaluation criteria for the experimental project, and introducing a unified approach to the institutional support of cadastre maintenance at all levels. Implementation of these measures will enhance legal certainty, system integrity, and provide a reliable foundation for the digitalization of urban planning regulation in Ukraine. The results of the study can be used to draft new and improve existing legal acts regulating the functioning of the urban planning cadastre in Ukraine.
