PROCEDURAL PROCEDURE FOR PROVIDING INTERNATIONAL LEGAL ASSISTANCE DURING PROCEDURAL ACTIONS

Abstract

The article provides a comprehensive scientific and legal analysis of the procedural framework for providing international legal assistance during the conduct of procedural actions in criminal proceedings. The powers and functions of the relevant authorities and officials in the field of executing requests for legal assistance within the mechanism of international cooperation are examined. It is substantiated that the effective functioning of the institution of international legal assistance largely depends on a clearly defined procedure of interaction during the execution of procedural requests from foreign states.
The paper reveals the specific features of the procedural procedure for the preparation, submission, and execution of requests for international legal assistance. It is established that this procedure is regulated by the provisions of the Criminal Procedure Code of Ukraine, international treaties to which Ukraine is a party, as well as relevant subordinate regulatory legal acts. It is determined that the procedure for providing international legal assistance includes a number of consecutive procedural stages, in particular the preparation of the request, its transmission through central authorities, consideration by the competent authorities of the requested state, execution of the necessary procedural actions, and the transfer of the obtained results.
The article also emphasizes that an important element of the procedure for providing international legal assistance is the transfer of the results of the executed request. The obtained evidence, records of procedural actions, documents, or other materials are forwarded to the state that initiated the request through the relevant central authorities. It is also noted that contemporary practice of international cooperation involves the use of modern information technologies during the execution of requests for legal assistance.
It is concluded that the procedural framework for providing international legal assistance during the conduct of procedural actions constitutes an important instrument for ensuring the effective investigation of criminal offences of an international nature. The implementation of international legal assistance in criminal proceedings is based on a clearly established procedural procedure that provides for the interaction of competent authorities of different states.
